This Cancellation & Refund Policy (“Policy”) for users of the website www.upluxuryhousing.com (“Website”). This Policy outlines the terms under which users may cancel their registration and seek a refund for booking or registration amounts paid for projects listed on our platform. This Policy is in compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA), Consumer Protection (E-Commerce) Rules, 2020, and applicable Indian laws.

1. Scope

This Policy applies to all customers who have registered for any real estate project, shop, or property through our platform by making a payment of ₹49,000 or any other amount specified for the respective project.

2. Cancellation Terms

A customer may cancel their registration by submitting a written request via email or through their user dashboard (if available).

The cancellation request must include:

• Name of the project
• Date of registration
• Payment reference details
• Reason for cancellation (optional)
• Any cancellation made before entering into an Agreement to Sell or executing legal documentation with the developer will be eligible for a full refund of the registration amount.
• If any agreement or project-specific documentation has already been executed, cancellation will be governed as per the developer’s terms and applicable RERA regulations.

3. Refund Eligibility

The registration amount (₹49,000 or project-specific amount) is fully refundable in the following cases:

• Voluntary cancellation before execution of binding documentation
• Unavailability of the selected shop or unit after payment
• Project cancellation or delisting due to regulatory or developer-related issues

In cases where additional payments are made directly to the developer, refunds for those amounts will be processed by the developer as per their respective policies.

4. Refund Processing Timeline

• Standard Processing: Refunds are generally processed within 15 business days after receiving a complete cancellation request and required documents.
• Extended Processing: In exceptional cases, processing may take up to 45 business days due to verification, developer response, or compliance procedures.

5. Refund Method

• Refunds will be issued to the original payment method used during registration unless otherwise agreed.
• A confirmation via email or SMS will be sent once the refund has been processed.

6. Non-Refundable Scenarios

Refunds will not be applicable in the following situations:

• Cancellation after execution of legal documents (Agreement to Sell, Allotment Letter, etc.) where it contradicts developer terms
• Cancellation due to customer default, false information, or misrepresentation
• Violation of platform Terms & Conditions or misuse of promotional offers or third-party benefits

7. Governing Law

This Policy shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
